This document sets out the privacy policy of Forge Works Pty Ltd ABN 60 621 056 184 (referred to in this privacy policy as ‘we’, ‘us’, or ‘our’). For the purposes of applicable data protection law, (in particular, the General Data Protection Regulation (EU) 2016/679 (the “GDPR”) and the UK Data Protection Act 2018), your data will be controlled by us.

This privacy policy applies whenever we collect your personal information and/or personal data (your personal data). This includes between you, the visitor to this website (whether directly as our customer or as personnel of our customer), and us, the owner and provider of this website and also where we are directed by a third party to process your personal data. This privacy policy applies to our use of any and all data collected by us or provided by you in relation to your use of our website, our mobile applications, and the provision of our services to you.

We take our privacy obligations seriously. 4. when you or your organisation offer to provide, or provides, services to us;

6. invest in our business or enquire as to a potential purchase in our business.

We may also collect personal data from you when you use or access our website or our social media pages. This may be done through use of web analytics tools, ‘cookies’ or other similar tracking technologies that allow us to track and analyse your website usage.

We collect and use personal data for the following purposes:

   5. the delivery of our services.

Sharing your data

We may share your personal data in certain circumstances, as follows:

1. where there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal data and non-personal data contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances;
2. credit-checking agencies for credit control reasons;

However, we cannot guarantee the security of your personal data.

Transfers outside the European Economic Area (‘EEA’)

When we do this, we will make sure that it is protected to the same extent as in the EEA and UK as we will put in place appropriate safeguards to protect your personal data, which may include standard contractual clauses.

Data the app collects

What the app does not collect

• Location. The app does not request or collect device location. Worksite names and addresses are entered by your organisation and are not derived from your device’s GPS.
• Microphone or audio. The app does not request microphone access and does not record audio.
• Contacts, calendar or files, beyond photographs you explicitly attach.

Who processes this data

We use the following service providers, who process data on our behalf and under contract. We do not sell your personal data, and we do not share it with advertising networks or data brokers.

Automated processing of your observations

When you record an observation, the text and any photographs you attach are processed by an automated (artificial intelligence) service operated on our behalf by Amazon Web Services, in order to summarise and classify what you have described and to identify patterns across observations. This processing supports the insights presented in the app. It does not make decisions about you, and the resulting insights are reviewed by people in your organisation before any action is taken.

Credentials stored on your device

Your sign-in credentials are stored in the secure storage provided by your device’s operating system, which may be protected by your device passcode or biometrics. We do not collect or receive your biometric data.

Visibility within your organisation

Observations, photographs and insights you create in the app are visible to authorised colleagues within your own organisation — typically safety managers and leaders. They are not public, are not shared with other customers, and cannot be discovered by users outside your organisation.

Security in transit

All data transmitted between the app and our services is encrypted in transit using industry-standard transport encryption (HTTPS/TLS).

Retention, correction and deletion

Because Hiviz Sight is provided to organisations rather than to individual consumers, the safety records created in the app belong to your employer and are retained for the term of their agreement with us and any period required by law. Accounts are created and deactivated by an administrator at your organisation.

To request access to, correction of, or deletion of your personal data held in the app, contact your organisation’s administrator, or contact us directly at info@forgeworks.com and we will respond in accordance with the rights set out above.

Children

Hiviz Sight is a workplace application intended for use by people aged 18 and over. It is not directed at children and we do not knowingly collect personal data from children.
